Limitation of liability
St. James's Group Ltd shall have no liability for any defect
in the Site and its related services caused or contributed
to by you and/or any other site user.
Except in the case of death or personal injury caused by
St. James's Group Ltd negligence or in other circumstances
where liability may not be so limited under applicable law,
Our liability under or in connection with this agreement,
whether arising in contract, tort, negligence, breach of
statutory duty or otherwise, shall not exceed the sum of
twice the amount paid by you.
Complaints
Initial complaints should be made by email to St. James's
Group Ltd at the above email. We will endeavour to acknowledge
complaints within 5 working days and will provide information
on the likely timescale for resolving the complaint. We
will endeavour to take appropriate action to resolve complaints
as soon as possible.
Notices
Any notice shall be in writing and shall be hand-delivered
or sent by first-class post or by email (confirmed by first-class
post) to the address of the relevant party. The email and
postal addresses of St. James's Consultancy are given above.
Notices sent as above shall be deemed to have been received
at the time the same is left at the address of or handed
to a representative of the party, or 3 working days after
the day of posting, or on the next working day after transmission
in the case of email but only if an 'Email Sent Confirmation'
report is generated by the sender's machine recording a
message from the sender's machine confirming that the email
was sent to the address of the relevant party and confirming
that the message was successfully transmitted and/or acknowledged.
Force Majeure
Both parties shall be released from their respective obligations
in the event of national emergency, war or prohibitive governmental
regulations, civil commotion, epidemic, fire, flood, industrial
action, failure of payment systems, default of suppliers
or subcontractors or damage to any computer or telecommunications
systems or if any other cause beyond the control of the
parties shall render performance of this agreement impossible.
Headings
The headings in this document are inserted for convenience
only and shall not affect the construction or interpretation
of the Terms and Conditions.
Priority of terms
Additional services including but not limited to social
events and competitions may be subject to separate terms
and conditions. If there is any conflict in meaning between
any provision of the Terms and Conditions and a provision
relating to such additional service, the additional provision
shall prevail.
Waiver
Any waiver by St. James's Group Ltd of any breach of any
of your obligations under this agreement or otherwise shall
not be a waiver of any continuing breach or of any other
breach of any of those obligations.
Third parties
All third party rights are excluded and no third parties
shall have any right to enforce this agreement.
Survival of terms
No term shall survive expiry or termination of this agreement
unless expressly provided.
Assignment
We may assign, delegate, sub-contract, mortgage, charge
or otherwise transfer any or all of Our rights and obligations
under these Terms and Conditions at any time. You may not
assign, delegate, sub-contract, mortgage, charge or otherwise
transfer your rights and obligations under these Terms and
Conditions without Our prior written permission.
Law and Jurisdiction
These terms and conditions are governed by English law and
you submit to the exclusive jurisdiction of the English
courts. If any provision shall be unlawful, void or for
any reason unenforceable then that provision shall be deemed
severable and shall not affect the validity and enforceability
of the remaining provisions.
